Fatal pues los sistemas energéticos han generado la mayor parte de las emisiones de gases efecto invernadero desde por lo menos la segunda mitad del siglo veinte. Por lo tanto, es indispensable analizar las cuestiones de energía desde el punto de vista de su uso buscando responder preguntas como ¿cuánta energía se requiere para mantener o mejorar niveles (...) de bienestar humano?, ¿qué países han logrado alcanzar niveles altos de bienestar con niveles relativamente bajos de uso de la energía y cómo lo han logrado?, ¿qué impacto tiene nuestra comprensión del bienestar humano en cómo reflexionamos sobre la relación entre energía y bienestar? Este artículo tiene como objetivo presentar la historia del estudio de las relaciones energía-bienestar imperativa en la lucha por mitigar el cambio climático, desde una perspectiva de límites medioambientales. Opportunistic behaviors are considered ethically and strategically troublesome since they disrupt otherwise mutually beneficial relationships. Previous literature has shown that firms attempt to protect their investments from opportunism by generating a large amount of patented marginal innovations in domains central to their industry. However, this approach may generate some ethical dilemmas by preventing firms and societies from more radical, collaborative, and much-needed environmental progress. We extend the environmental innovation literature using strategic and ethical lenses to analyze the potential of an (...) alternative, divergent way to provide financial opportunities for a focal firm without aiming to prevent innovative opportunities for competitors. Our longitudinal analysis of 6768 environmental patents from 59 large companies worldwide in the electrical components and equipment industry shows that high levels of innovation intensity, environmental scope, bargaining power, and environmental expertise increase the incidence of patented environmental innovations related to domains in which industry competitors are less focused (i.e., technological divergence). We also show a positive relationship between this divergence and market-based firm performance. Our results suggest that pursuing innovative divergence to avoid opportunism may make ethical and market sense and we also identify the organizational factors that can support these efforts. A frequent justification in the literature for using stated preference methods (SP) is that they are the only methods that can capture the so-called total economic value (TEV) of environmental changes to society. Based on follow-up interviews with SP survey respondents, this paper addresses the implications of that argument by shedding light on the construction of TEV, through respondents' perspective. It illuminates the deficiencies of willingness to pay (WTP) as a measure of value presented as three aggregated themes considering respondents' (...) unintentionality, their retraction once they understood that their WTP could be decisive in cost-benefit analysis and the inherent incompleteness of WTP. We discuss why the TEV discourse persists, how it conceals rather than reveals broader notions of value and in what ways our results support the development of alternative approaches that truly endorse plurality in environmental valuation and decision-making. Legal interpretation is a complex subject that raises several problems, and one of them relates to the question whether legal interpretative propositions are objective. This paper analyzes the problem of rational justification of law in general and legal norms in particular, a problem highlighted by the so-called postmodern trends that deny the possibility and validity of these attempts. While the postmodern trends serve as a background to the discussion, the article provides a summary of rational justification of norms based on Sergio Cotta’s innovative approach, who is arguably one of the authors that has dealt to the topic with more prominence and consistency. Thus, the (...) goal of this article is to point out how the election of a norm can be justified, and to explain the main notions of Cotta’s approach, in order to assess his accuracy and weakness, and his connection to the theory of practical knowledge. The article concludes with some remarks on Cotta’s justification model.Resumen:El presente artículo desarrolla el problema de la justificación racional del derecho en general y de las normas jurídicas en particular, ante las corrientes de pensamiento denominadas posmodernas que niegan la posibilidad y validez de tales intentos. El trabajo ofrece una reseña acerca de la justificación racional de las normas a partir de la novedosa doctrina de Sergio Cotta, quien es uno de los autores que ha abordado el tema con mayor extensión y consistencia. A lo largo del artículo, el autor intenta mostrar de qué manera está fundada la elección de una norma, explica las nociones centrales de la doctrina de Cotta, identifica sus aciertos, sus debilidades, su conexión con la teoría del conocimiento práctico y concluye con algunas observaciones al modelo de justificación propuesto. Probabilism is committed to two theses: 1) Opinion comes in degrees—call them degrees of belief, or credences. 2) The degrees of belief of a rational agent obey the probability calculus. Correspondingly, a natural way to argue for probabilism is: i) to give an account of what degrees of belief are, and then ii) to show that those things should be probabilities, on pain of irrationality. Most of the action in the literature concerns stage ii). Assuming that stage i) has been (...) adequately discharged, various authors move on to stage ii) with varied and ingenious arguments. But an unsatisfactory response at stage i) clearly undermines any gains that might be accrued at stage ii) as far as probabilism is concerned: if those things are not degrees of belief, then it is irrelevant to probabilism whether they should be probabilities or not. In this paper we scrutinize the state of play regarding stage i). We critically examine several of the leading accounts of degrees of belief: reducing them to corresponding betting behavior (de Finetti); measuring them by that behavior (Jeffrey); and analyzing them in terms of preferences and their role in decision-making more generally (Ramsey, Lewis, Maher). We argue that the accounts fail, and so they are unfit to subserve arguments for probabilism. We conclude more positively: ‘degree of belief’ should be taken as a primitive concept that forms the basis of our best theory of rational belief and decision: probabilism. (shrink)

I show that the Lottery Paradox is just a version of the Sorites, and argue that this should modify our way of looking at the Paradox itself. In particular, I focus on what I call “the Cut-off Point Problem” and contend that this problem, well known by Sorites scholars, ought to play a key role in the debate on Kyburg’s puzzle. Very briefly, I show that, in the Lottery Paradox, the premises “ticket n°1 will lose”, “ticket n°2 will lose”… “ticket (...) n°1000 will lose” are equivalent to soritical premises of the form “~(the winning ticket is in {…, (tn)}) ⊃ ~(the winning ticket is in {…, tn, (tn + 1)})” (where “⊃” is the material conditional, “~” is the negation symbol, “tn” and “tn + 1” are “ticket n°n” and “ticket n°n + 1” respectively, and “{}” identify the elements of the lottery tickets’ set. The brackets in “(tn)” and “(tn + 1)” are meant to point out that in the antecedent of the conditional we do not always have a “tn” (and, as a result, a “tn + 1” in the consequent): consider the conditional “~(the winning ticket is in {}) ⊃ ~(the winning ticket is in {t1})”). As a result, failing to believe, for some ticket, that it will lose comes down to introducing a cut-off point in a chain of soritical premises. In this paper I explore the consequences of the different ways of blocking the Lottery Paradox with respect to the Cut-off Point Problem. A heap variant of the Lottery Paradox is especially relevant for evaluating the different solutions. One important result is that the most popular way out of the puzzle, i.e., denying the Lockean Thesis, becomes less attractive. Moreover, I show that, along with the debate on whether rational belief is closed under classical logic, the debate on the validity of modus ponens should play an important role in discussions on the Lottery Paradox. -/- . Objectification is a notion central to contemporary feminist theory. It has famously been associated with the work of anti-pornography feminists Catharine MacKinnon and Andrea Dworkin, and more recently with the work of Martha Nussbaum. However, objectification is a notion that has not yet been adequately defined. It has been used rather vaguely to refer to a broad range of cases involving, in some way or another, the treatment of a person as an object. My purpose in this paper is to (...) offer a plausible understanding of objectification. I do that by focusing on the work of four prominent thinkers: Immanuel Kant, and contemporary feminists Catharine MacKinnon, Andrea Dworkin and Martha Nussbaum. Through drawing on these thinkers' conceptions of objectification, I am finally led to a more complete and coherent understanding of this notion. (shrink)

Kant has famously argued that monogamous marriage is the only relationship where sexual use can take place "without degrading humanity and breaking the moral laws." Kantian marriage, however, has been the target of fierce criticisms by contemporary things: it has been regarded as flawed and paradoncal, as being deeply at odds with feminism, and, at best, as plainly uninteresting. In this paper, I argue that Kantian marriage can indeed survive these criticisms. Finally, the paper advances the discussion beyond marriage. Drawing (...) on Kant 's conception of friendship, I suggest that he might have overlooked the possibility of sex being morally permissible in yet another context. (shrink)

This paper employs _Conversation Analysis_ to investigate a specific interactional environment in Swedish police interviews (PIs): sequences where the interviewee asserts an inability to recollect specific events, and the police subsequently challenge this assertion. The police interview serves as a crucial setting for reconstructing past events and identifying the distribution of knowledge among participants. While previous research has delved into the cognitive mechanisms underlying memory retrieval in PIs, there exists a scarcity of empirical investigation of how memories and their associated (...) knowledge are interactionally managed within this high-stakes activity. Prior Conversation Analytic studies exploring how epistemic dimensions shape social interaction form the theoretical basis for the current study, including research indicating how ‘forgetfulness’ can be strategically employed as an interactional resource. Only a few studies have targeted recorded high-stakes interviews in Swedish, and the lack of such is problematic since international research have highlighted the influence of cultural and social factors on conditions and outcomes. Data used for this study comprises anonymized audio recordings (N = 51) from a preliminary murder investigation, making a valuable contribution to the understanding of interactional practices in Swedish police interviews. Results indicate a discrepancy in orientation between the police and the interviewee. The former treats the memories as accessible _knowables_ possible to retrieve, in contrast to the latter, who uses the police’s challenge as a vehicle for contesting the ‘impossible action of remembering.’.
